2018 World AIDS Day Art Exhibit Contest OFFICIAL RULES

    1. AIDS Healthcare Foundation (“AHF”) will award prizes to each winner of the 2018 World AIDS Day Art Exhibit Contest (the “Contest”) according to the terms and conditions of these rules. The Contest will run from November 1, 2018 to November 26, 2018. Details of the contest and these rules are also available on the Contest website located at https://www.ahf.org/wad (“Website”).
    2. AHF will award a cash prize of one thousand dollars ($1000.00) to each eligible winner as detailed in these rules.
    3. The contest is sponsored by AIDS Healthcare Foundation (“Sponsor”).
    4. Except as set forth below, all individuals over the age of 17 are eligible to participate in the Contest. Each individual that participates in the Contest agrees to be subject to, and abide by, these rules. Any deviation from these rules, on the part of any participant, will render that participant ineligible. All decisions of the Sponsor are final.
    [OPTIONAL: The Sponsor, and its respective affiliates, subsidiaries, agencies and divisions, participating promotional partners, and each of their respective employees and immediate family members (including, but not limited to, children, parents, spouses, grandparents, and domestic partners of employees) are ineligible to participate in the contest.]
    1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
    2. HOW TO PARTICIPATE.
      1. You must submit a work of art (the “Work”) with the following specifications:
        1. Each Work must be designed for and submitted to an AHF Affinity Group that is organized at the location of one of AHF’s various local 2018 World AIDS Day events (each, an “Event”). A list of events and Affinity Groups is attached to these rules.
        2. The Work must meet the requirements and specifications of the Affinity Group that you are submitting the Work to.
      2. The WORK must be your own and original work only. It cannot subject to any copyright or other restrictions.
      3. You must and do agree that:
        1. You are transferring, without limitations, your title, ownership rights, copyright and all other interests in the Work to AHF;
        2. You are relinquishing any claim that you may have to the Work, either now or in the future, in favor of AHF; and,
    • If the Work is a work of visual art under the Visual Artists Rights Act of 1990, 17 U.S.C. § 106A (as amended, “VARA”), then you also waive your rights under VARA by agreeing to and certifying the following statement:

    “As author of the Work under these rules, I hereby permanently waive my rights pursuant to 17 U.S.C. §106A(a)(3) to prevent any distortion, mutilation, modification or destruction of that Work, for whatever reason and for whatever use of the Work such distortion, mutilation, modification or destruction of the Work is undertaken. This waiver does not extend to the rights of attribution conferred by 17.U.S.C. §106A(a)(1) or §106A(a)(2).

    1. When the Work is ready, you must submit your completed entry along with the Work to the Affinity Group.
    2. You may submit only one Work per entry. However, you may submit multiple entries.
    3. You must meet and fulfill all terms and conditions of this rule to be eligible to win a prize.
    1. EVALUATION; SELECTION OF WINNERS. Winners will be selected at each Event.
      1. Each Affinity Group will review and evaluate the Works submitted to it based on the following factors:
        1. Overall creativity
        2. Originality and effectiveness of theme
      2. Using the above criteria, the Affinity Group will select certain Works for display at that Affinity Group’s local Event.
      3. Attendees at each Event will vote for their favorite Work from each Affinity Group, by using the AHF App, which will tally the total number of votes for each Work.
      4. At each Event, the winning for each Affinity Group will be the one that receives the highest number of votes from the attendees.
    2. PRIZE RESTRICTIONS/CONDITIONS. The contest prize is non-transferable and non-assignable. Winners are solely responsible for all taxes associated with any prize.
    3. RULES; WINNERS LIST. They are also available between 9:00 a.m. and 5:00 p.m. PST, at 6255 W. Sunset Boulevard, 21st Floor, Los Angeles, CA 90028. To receive a copy of these rules by mail, please send us a stamped, self-addressed envelope that identifies the Contest, to this same address. You can also view these rules online at the Website.
    4. GENERAL CONDITIONS. Sponsor reserves the right, in its sole discretion, to disqualify any individual who Sponsor reasonably believes has tampered with the entry process or the operation of the Contest, or has acted in violation of these rules, or in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person, or for any other action deemed that Sponsor deems unacceptable. Sponsor reserves the right to change these rules at any time as it determines necessary in its sole discretion. If such changes occur after the Contest has begun, then Sponsor will post all such changes on Sponsor’s Website on the day that the change takes effect.  Sponsor reserves the right to terminate the contest if fraud, misconduct or technical failures adversely affect the integrity of the Contest.
    5. LIMITATIONS OF LIABILITY. All participants agree to release and hold harmless Sponsor and all of Sponsor’s affiliated companies and subsidiaries and all of their respective directors, officers, employees, agents, legal counsel, and/or participating promotional partners from all losses, damages, penalties, claims, actions, suits, costs, and expenses of any kind whatsoever and any property damage, personal injury, or death to any participant or third party caused by or arising out of or in connection with participation in the contest or with the use of any prize awarded. Sponsor is not responsible for any incorrect or inaccurate information and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the contest of the equipment used in its administration.
    6. As a condition to participating in the contest, participants agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or in connection with this contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Los Angeles, California having competent jurisdiction, which court shall apply the laws of the State of California without regard to any conflicts of Laws principles. Further, in any such dispute, under no circumstances will participants be permitted awards for, and each hereby waives all rights to claim punitive, incidental or consequential damages, or attorneys’ fees.
